Prior winners of the “Picture in the Park Photo Contest” are ineligible to enter. Void where prohibited.   

HOW TO ENTER:

Your photo submission will be your official entry into the Contest. You must enter online at  www.omaha.com/pictureinthepark. Register by filling out the registration form or if you have already registered for an Omaha World-Herald contest, login using your username and password. Upload your photos. There is no photo limit. Choose the appropriate title for your photo(s).  A panel of judges will decide the top three (3) photos and the winners will receive the following prizes: 1st prize is a 7.2 FX bike from Trek Bicycle Store and a City of Omaha 2016 Family Pool Pass (total retail value $665.00)). Second prize is a $50.00 Peak Performance gift certificate and a City of Omaha 2016 Family Pool Pass (total retail value $225.00). Third prize is a $50.00 Peak Performance gift certificate .

1. All entry forms must be received by Omaha.com by no later than midnight on Wednesday, September 30, 2015 to be eligible for the prizes. The same photo cannot be entered more than once. Entries (which include any photo submitted and any information on an entrant’s official entry form) may be published by the Omaha World-Herald or its affiliates in their sole discretion in any form of media at any time, including but not limited to publication in the Omaha World-Herald newspaper or on any of its websites, including but not limited to omaha.com and livewellnebraska.com. The City of Omaha has the right to re-publish photos at any time in any form of media.Participant shall not receive any payment for any use or publication of submitted photos by the Omaha World-Herald and its affiliates, Omaha.com, livewellnebraska.com, or the City of Omaha. Sponsor is not responsible for misdirected, lost, late, or damaged entries. All entries become the property of the Sponsor and will not be acknowledged or returned. The Omaha World-Herald reserves the right to reject any submission.

B.            Photos must be taken at an Omaha Parks & Recreation Park or Facility. Ideas on locations may be found in the Omaha Parks & Recreation Discovery Guide located at http://parks.cityofomaha.org/discovery-guide. When you submit a photo, we will ask you where it was taken. We allow users to report a photo if it’s not from an Omaha Parks & Recreation location. Photo guidelines are as follows:

• JPEG format.
• Photos must be high resolution (200 dpi or higher)
• You must be the photographer.
• No borders.
• No obtrusive text or watermarks on photo.
• No nudity.
• Taken at an Omaha Parks & Recreation park or facility.
• No collages.
• No enlargements. Photo must be uploaded in its original size.
• No non-photos such as drawings, paintings, and screen shots.
• No filters.

1. Please provide a caption for your photo that is concise and relevant. We may use or edit your caption.

    

2. ENTRY CONSTITUTES PERMISSION TO PUBLISH.Any photo submitted during the Contest (and any information submitted by the entrant on the online entry form, including but not limited to caption and entrant’s name) may be published in any form of media by the Omaha World-Herald Company or its affiliates or the City of Omaha, including but not limited to the Omaha Parks and Recreation Department. Any such publication may include, but is not limited to, publication in the Omaha World-Herald newspaper and/or omaha.com or livewellnebraska.com, or in any brochure or marketing publication for Omaha Parks & Recreation, at any time and for any length of time, including but not limited to publication for any marketing, advertising or other form of promotion for this Contest or any other photo contest by Sponsor.Any publication pursuant to the rights granted herein does not entitle the entrant or any other person to any form of compensation. Entrant represents and warrants (i) the photo is his/her original work, (ii) no part of the photo will infringe upon, violate or misappropriate the copyright or other rights of any third party, and (iii) the photo will not contain defamatory or libelous matter, or invade or intrude upon the privacy or publicity rights of any person. If an entrant in this Contest submits a photo, such entrant agrees he/she owns all right, title and interest in the photo(s) and the entrant must have obtained the permission of all persons identifiable in the photo to submit any photo in this Contest. Submission of any photo in this Contest constitutes the entrant’s representation that the conditions in this paragraph have been satisfied. Each entrant shall hold the Sponsor harmless from claims of any third party relating to publication by the Omaha World-Herald Company of the photo or any information provided by the entrant in any form of media, including but not limited to publication in the Omaha World-Herald newspaper or on any of its websites, including but not limited to omaha.com and livewellnebraska.com. By submitting any photo, the entrant grants Omaha World-Herald Company the rights and privileges set forth in these rules.

ALTERNATIVE METHODS OF ENTRY: As an alternative to entering pursuant to the paragraph  above, you may enter by delivering your name, complete address, phone number and date of birth, all legibly handwritten on a 3" x 5" piece of paper, to the Omaha World-Herald Building at 1314 Douglas Street, Omaha, Nebraska, or the 3" x 5" piece of paper may be mailed to: Omaha World-Herald Picture in the Park Promotion, 1314 Douglas St., Suite 600, Omaha, NE 68102. Entries submitted by this alternative method must be received by the Omaha World-Herald by 5 p.m. on September 30, 2015.

SELECTION OF WINNERS AND PRIZES:

A panel of judges will decide the top three photos and the winners will receive the following prizes: 1st prize is a 7.2 FX bike from Trek Bicycle Store and a City of Omaha 2016 Family Pool Pass (total retail value $665.00). If the Sponsor is unable to locate a given winner, an alternate winner will be selected by a random drawing. All prizes are non-transferable. No cash or other substitutions are allowed. All taxes and all other expenses or liabilities associated with the acceptance and/or use of any prize are the sole responsibility of each winner.

Each winner’s photo and name (and other information submitted by the entrant, such as caption) may in Sponsor’s sole discretion be posted (in a form and format and for such duration as determined by the Sponsor) on both the Omaha World-Herald newspaper and the Contest page on omaha.com, and may be used in any promotion or advertising of this Contest or similar future photo contest by Sponsor.  Entry in the promotion or acceptance of any prize constitutes permission to publish each winner’s name, information submitted pursuant to Contest entry (including caption), and photo submission in any form of media.

By entering this Contest, each winner assumes all liability for any injury or damages caused or claimed to be caused by participation in the Contest and/or the acceptance and/or use of any prize. Each winner hereby releases the Omaha World-Herald and each of its respective officers, directors and employees, from any such liability. Entry or acceptance of any prize constitutes permission (except where prohibited by law) to use or publish each winner’s name, information submitted pursuant to Contest entry, and the submitted photograph in any form of media for purposes of advertising promotion and publicity without compensation, and the Omaha World-Herald is released from all liability relating to use or publishing each winner’s name, caption and/or the submitted photograph in any form of media in any manner.

MISCELLANEOUS:

This Contest is sponsored by the Omaha World-Herald, City of Omaha Parks & Recreation Department, Blue Cross Blue Shield of Nebraska, Heartland B Cycle, Trek Bicycle Store and Peak Performance. Sponsor reserves the right to withdraw or cancel this promotion at any time for any reason and award the prize from among the eligible entries received prior to the date of the withdrawal or cancellation. Entrants agree to abide by these Official Rules and by the decisions of the judges, whose decisions are final. Failure to comply with these rules may result in disqualification from this promotion. Sponsor reserves the right to permanently disqualify from this promotion any person it believes has violated these rules.

If for any reason the Contest is not capable of being conducted as planned due to any cause beyond the control of Sponsor, including but not limited to any event or cause which corrupts or affects the administration, security, fairness, integrity or proper conduct of the promotion, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest and disqualify any individual who may have caused any such problem. Sponsor assumes no responsibility for any theft or destruction, unauthorized access to, or alteration of entries. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, unauthorized access to, or alteration of entries. Sponsor is not responsible for any problem or technical malfunctions of any telephone network or lines, computer online systems, servers or provider, computer equipment, software, failure of any entry to be received by Sponsor on account of technical problems or delays, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this Contest. If a dispute arises regarding who submitted an entry, the entry will be deemed submitted by the person in whose name the entry was made.

By entering this Contest, each entrant agrees that (i) any and all disputes, claims, and causes of action arising out of or in connection with this Contest, the drawing or the prize awarded, shall be resolved individually, without resort to any form of class action; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs, directly or indirectly associated with entering this Contest, but in no event will attorneys' fees be awarded or recoverable; and (iii) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby knowingly and expressly waives all rights to, any damages other than actual out-of-pocket expenses.

The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. IN NO EVENT SHALL SPONSOR BE LIABLE FOR ANY CONSEQUENTIAL, SPECIAL, INDIRECT, INCIDENTAL OR PUNITIVE DAMAGES, EVEN IF IT HAS BEEN ADVISED OF THE POSSIBILITY OF THE DAMAGES. IN ANY EVENT THE MAXIMUM AGGREGATE LIABILITY OF SPONSOR TO ANY PERSON DIRECTLY OR INDIRECTLY RELATING TO THIS CONTEST OR PROMOTION OR THE AWARD, USE OR ENJOYMENT OF ANY PRIZE SHALL NOT EXCEED THE SUM OF $10.00.
